Upon being retained, Attorney Donald Kilfin thoroughly interviews each and every client to develop an understanding of the case, from the client's perspective, in an effort to identify any potential weaknesses in the state's case. As a former Pinellas County state prosecutor, Mr. Kilfin spent years building thousands of criminal cases, from pre-charge investigation through trial and appeal. He knows where to look for potential defenses, including lack of sufficient evidence to establish identification, lack of reasonable suspicion to conduct an initial stop and/or interrogation, lack of probable cause to make an arrest, potential fourth amendment violations, including unlawful search and/or seizure of evidence, Miranda warnings violations, coerced statements, and/or an overall lack of sufficient corroborative evidence to support a criminal charge. More "technical" defenses may also be available, such as the expiration of speedy trial or the applicable statute of limitations.

After developing a thorough understanding of the facts, Mr. Kilfin turns his attention to the client's history and characteristics, including mental health and/or addiction issues, prior contacts with the criminal justice system, family and employment circumstances, and any other information that may be germane to mitigating, or eliminating, the impact of a criminal charge. Often times, there is a certain duality to crafting an effective solution to a client's legal problem; attacking the merits of the case is but one component.

During this critical time, attention to detail is paramount. In many instances, the outcome of a case can turn on the existence (or non-existence) of one or two seemingly minute facts. Sometimes the initial interview with Mr. Kilfin may need to continued to another day or even days, and he may require the client to provide certain documents or enroll in a certain type of treatment program depending on the nature of the charge. In every situation, his focus is on the client's best interests and attaining the best possible result for that person.
